Delaware County Criminal Defense Attorneys
Arrested in Delaware County?
If you or someone you know has been charged with a crime in Delaware County, you need an experienced Delaware County criminal defense attorney by your side throughout the process.
When an individual is arrested for a crime in Delaware County, their first appearance in court will take place at the District Court in the township or borough in which they were arrested in.
If you are charged with a Misdemeanor or Felony, you will have a preliminary hearing at the District Court level.
At a preliminary hearing, the District Attorney presents evidence that proves there is enough evidence that a crime has been committed and that you are most likely the one who committed the crime. If the District Attorney has established their "prima facie" case, the Judge will then send the case up to the Court of Common Pleas. If the Judge determines that the District Attorney has not established their case, he/she may dismiss the charges and the case will end there.
If the Judge, determines there is enough evidence to hold your charges over for a trial, your case will then be transferred to the Court of Common Pleas in Media where you will either fight the case or enter into a guilty plea.
